Disclaimer
The user expressly agrees that the risk of using the Black Diamond intelligent trading system will be borne entirely by himself; because all the consequences of using the software are also borne by himself, the software developer does not bear any responsibility to the user.
The developer of this software will not bear any responsibility for network service interruption or other defects caused by force majeure or reasons beyond the control of the software developer, but will try to reduce the losses and impact on users caused by it.
This software does not bear all the losses caused by the foreign exchange platform, network, computer and other peripheral facilities. If cracked, all the consequences caused by the pirated version of the software shall be borne by the user. At the same time, it should also bear legal responsibility. The use of this software cannot replace the will of the user himself. The use of this software is a reflection of the user's own operating ideas. All profits and losses of using the software are borne by the user, and have nothing to do with the software itself.
Service
In order to provide normal services, the software developer will periodically or irregularly repair or maintain related equipment and cause network service interruptions. The software developers try their best to avoid service interruptions or limit the interruption time to the shortest time, within a reasonable time. Service interruption, software developers do not need to take any responsibility for this. In any of the following situations, the software developer has the right to interrupt or terminate the service to the user at any time. Without any liability to the user or any third party:
（1） The information provided by the user is not true;
（2） The user violates the relevant provisions of the Terms of Service;
（3） The user did not pay the corresponding fee to the software developer when using the paid product service.
Rules of use
When applying for the use of the Black Diamond Intelligent Trading Series software services, users must first learn the operating methods carefully. Before you can fully use the software, you can start using it. The software developer must be provided with accurate personal data, and any changes in personal data must be updated in a timely manner.
After the user is successfully registered, each user will get a user account and corresponding password, and the user account and password are the responsibility of the custody of the user; the user shall be legally responsible for all activities and events performed under his user account. The user can change the user's password at any time as prompted. Users should not transfer or lend their account and password to others. If the user finds that his account is illegally used by others or there is a security breach, he should immediately notify the software developer. The software developer does not bear any responsibility for the illegal use of the account and password due to hacking or negligence of the user.
Users must follow the following principles when using the Black Diamond Intelligent Trading Series software services:
Comply with BVI and SINGAPORE related laws and regulations;
Do not use the service system for any illegal purpose;
Comply with all service-related network protocols, regulations and procedures;
Only one terminal is allowed to log in to each account. Cracking is strictly prohibited. Those with serious circumstances will be held legally responsible.
Service change, interruption or termination
如因系统维护或升级的需要而需暂停网络服务，软件开发商将尽可能事先进行通告。 如发生下列任何一种情形，软件开发商有权随时中断或终止向用户提供本协议项下的网络服务而无需通知用户：
(a) The personal information provided by the user is not true;
(b) The user violates the usage rules stipulated in this agreement.
(c) Changes in relevant national industry laws and regulations; except for the situation described in the preceding paragraph, the software developer also reserves the right to interrupt or terminate some or all of the network services at any time without prior notice to the user, resulting in the interruption or termination of all services The software developer does not need to bear any responsibility to the user or any third party for any loss.
The user will receive a short message notification after successful registration. Your usage time will take effect. The charging user should pay the relevant usage fee within three working days in advance. We will inform you in advance so as not to affect your normal use.
privacy protection
Protecting user privacy is a basic policy of the software developer, except for the following:
Obtain explicit user authorization in advance;
In accordance with relevant laws and regulations;
According to the requirements of relevant government authorities;
For the benefit of the public;
To protect the legitimate rights and interests of the software developer.
The user agrees to protect and safeguard the interests of the software developer and other users. If the user violates the relevant laws, regulations or any terms under this agreement, the user will be responsible for any losses caused by the software developer or any other third party Liability for damages.
Legal jurisdiction
The conclusion, implementation and interpretation of this agreement and the resolution of disputes shall be governed by the laws and regulations of BVI and SINGAPORE.
If there is any dispute between the two parties regarding the content of this agreement or its implementation, the two parties shall try to resolve the issue with friendly negotiation; if the negotiation fails, either party may bring a lawsuit to the court where the software developer is located.
If any provision of this agreement is wholly or partially invalid or unenforceable for whatever reason, the remaining provisions of this agreement shall remain valid and binding.
The headings in this agreement are for convenience only and should be ignored in interpreting this agreement.
